Dom. La Asociaci\u00f3n Nacional de J\u00f3venes Empresarios (ANJE) deposit\u00f3 una serie de observaciones t\u00e9cnicas sobre el proyecto de ley que persigue modificar el C\u00f3digo de Trabajo, ante la C\u00e1mara de Diputados, con el objetivo de contribuir a una reforma equilibrada, coherente con la realidad productiva nacional y alineada con los desaf\u00edos de competitividad, formalizaci\u00f3n y protecci\u00f3n de los derechos laborales.<\/p>\n<p class=\"wp-block-paragraph\">A trav\u00e9s de una comunicaci\u00f3n dirigida al presidente de la C\u00e1mara de Diputados, Alfredo Pacheco, ANJE subray\u00f3 que persisten importantes retos que deben ser atendidos en el proceso legislativo como presupuesto para una norma laboral que realmente responda a la prospectiva de desarrollo a largo plazo del Estado dominicano.<\/p>\n<p class=\"wp-block-paragraph\">El gremio precis\u00f3 que, bajo la propuesta actual, el Comit\u00e9 Nacional de Salarios puede fijar salarios m\u00ednimos sin tomar en consideraci\u00f3n los criterios oficiales para la clasificaci\u00f3n de MIPYMES, pudiendo afectar el flujo de caja y la sostenibilidad financiera, por lo que recomendaron que se tomen en cuenta los umbrales establecidos en las resoluciones emitidas por el Ministerio de Industria y Comercio y MIPYMES.<\/p>\n<p class=\"wp-block-paragraph\">Adem\u00e1s, resaltaron que no se justifica que las MIPYMES posean el mismo plazo para el pago de las prestaciones laborales y penalidades por retrasos, planteando una propuesta con plazos m\u00e1s amplios y diferenciados para estos pagos. Por otro lado, apuntaron que la regulaci\u00f3n propuesta del teletrabajo resulta excesivamente r\u00edgida y mantiene una imposici\u00f3n uniforme de costos operativos bajo la discrecionalidad del Ministerio de Trabajo, lo que pudiera desincentivar la formalidad en un momento de auge de la econom\u00eda digital.<\/p>\n<p class=\"wp-block-paragraph\">Los j\u00f3venes empresarios destacaron que la normativa pudiera incentivar los embargos retentivos abusivos, permitiendo incluso la traba de embargos en m\u00faltiples entidades bancarias, afectando el flujo de caja y el ejercicio operativo de las MIPYMES. Resaltaron la importancia de que se establezca un l\u00edmite al monto embargable y se adopte un r\u00e9gimen de responsabilidad civil solidaria del ejecutante y abogados por embargos abusivos.<\/p>\n<p class=\"wp-block-paragraph\">En un momento en que se discuten las medidas propuestas por el gobierno del \u201cPlan Anticrisis\u201d, el gremio inst\u00f3 a los legisladores a ponderar la necesidad de no incrementar los costos para las MIPYMES. Los j\u00f3venes agregaron que cualquier reforma debe procurar coherencia con los esfuerzos de formalizaci\u00f3n y alivio regulatorio que actualmente se debaten en el pa\u00eds, evitando que nuevas cargas econ\u00f3micas, sancionatorias o administrativas debiliten a\u00fan m\u00e1s la capacidad de las MIPYMES para sostener empleos formales, invertir, crecer y competir en condiciones razonables.<\/p>\n<p class=\"wp-block-paragraph\">El presidente de ANJE, Boris De Le\u00f3n Reyes, indic\u00f3 que \u201ces de importancia capital avanzar hacia un nuevo C\u00f3digo de Trabajo que se encuentre a la altura de la actual din\u00e1mica econ\u00f3mica y la prospectiva de desarrollo a largo plazo.
